Public Guide Lines:

Application Process:

  •  Identify the information you need and the public Authority holding the information.
  •  Make a written request to the relevant Information Officer of the public Authority.
  •  If you are unable to write your request the Information Officer will assist you.
  • When you make an oral request the Information Officer assists you to make the request in the approved format (RTI-01 Application Form).
  •  When an information officer receives a request he/she issues an acknowledgement using RTI 02
  •  The decision on the request  is informed by the Information Officer within 14 days using RTI 04.
  •  If it involves the life or liberty of a person the decision will be made within 48 hours.

 

If your request is accepted

If your request is rejected

  • Will allow access to information within 14 Days.
  • Rejection of information request (RTI 05) will be sent.
  • If the information difficult to access, the period will be extended up to 21 days with the reasonable reason.
  • The grounds on which the request was refused.
  • Finally the information will be provided
  • The Period within which an appeal against the refusal  and the person to whom such appeal  should be  given

 

Appeal Process/ Appeal against the decision of the Information officer.

  •  Appeal to the designated officer within 14 days (RTI 10)
  • You can appeal for under mentioned reasons:
    • Rejects a request for information
    • Does not follow the time frame
    • Providing incomplete, misleading, or false information
    • Charges excessive fees
    • Refuses to provide information in the request form
    • You have reasonable belief that the request information has been  deformed or destroyed or misplaced
    • You are not satisfied with the reasons for the extension
  • Designated Officer may accept the appeal out of time if you exceed 14 days for reasons beyond your  control.
  •  Designated Officer acknowledge of an appeal  within 3 working days.

 

 

Appeal Procedure to the RTI commission

 

 The Right to Information commission is established by the Act to ensure the effective Implementation of the Act. It is an independent and transparent Body which is required to ensure that public Authorities duly discharge their duties under this Act.”

 

  • Appeal to the RTI commission within two months.
  • You can appeal for under mentioned reasons: 
    • You are not satisfied with the decision of the designated officer.
    • The Designated officer  does not make a decision within 3 weeks
  •  RTI Commission may accept the appeal out of time if exceeds 2 months for reasons beyond applicant’s control.
  • Such appeal shall be accompanied by the following documents duly verified as true copies by the applicant 
    • A copy of the request for Information submitted under section 24 of the Act
    • A copy of the reply, if any received from the Information Officer.
    • A copy of the appeal made to the Designated Officer under Section 31  of  the Act
    • A copy of the order, if any received by the Designated Officer.
    • Copies of other documents relied upon by the applicant and referred to his or her appeal along with an index of the documents referred to in the appeal.

  • RTI Commission has to make a decision within 30 days with reasons given. If you are not satisfied with the decision of the RTI Commission you can make an appeal  to the Court of appeal

Fees to be charged for providing information

  1. Application fees
  2. No public authority shall charge any fee to provide a right to the Information application form to a citizen making an information request.
  3. No public authority shall charge any fee to process a Right to Information request.

  • Rs.20/- for copying information onto a diskette, Compact Disc, USB mass drive, or similar electronic device, provided by the citizen making the request.

    Actual cost for copying information onto a Diskette, Compact Disc, USB mass drive, or similar electronic device provided by the public authority.

    Rs.50/- per hour for the study or inspection of any document or material, or inspection of a construction site, if this takes longer than one hour, with the first hour of study/ inspection being provided free of charge.

     This shall be without prejudice to the practice of public authorities which is previously such inspection free of charge and which practice shall continue notwithstanding this sub-rule. Samples or models will be charged the actual cost. Information provided via e-mail will be free of charge.

     Where there exists a previous fee schedule prescribed or issued by Public Authorities by way of circulars or regulations, that fee schedule shall continue to operate notwithstanding the fees prescribed in Rule 4.

    Provided that any dispute in regard to claims relating to existing fee e may be the subject of an appeal to be determined by the commission in accordance with these rules on fees and appeals.
